Terms of Service

These terms govern your use of the Youvoip cloud phone service and the website at youvoip.com. Youvoip is a service for businesses. By creating an account or using the service, you agree to these terms on behalf of yourself and the business you represent. If you do not agree, do not use the service. 1. Your account

You must give a valid work email address and keep your account details accurate. The person who creates the account is the account owner and is responsible for the users they invite, for the settings of the account and for all activity under it. Keep passwords and sign-in methods secure and tell us at [email protected] if you believe your account has been used without permission.

2. Subscriptions and billing

  • The service is sold as a subscription priced per user. Current plans and prices are shown on the VoIP pricing page.
  • You choose monthly or yearly billing. Yearly billing is charged in advance for twelve months.
  • The subscription renews automatically at the end of each billing period for the same period until you cancel it.
  • When you add users during a period, we charge for them from the day they are added. When you remove users, the change applies from the next renewal.
  • Prices do not include taxes and regulatory fees that apply to telecommunications services, which are shown on your invoice where they apply.
  • If we change the price of your plan, we tell the account owner by email before the change applies to your next renewal.
  • Enterprise plans may be invoiced with the payment terms stated in the Enterprise agreement.
  • The only free part of Youvoip is the call flow demo on the website. All plans are paid.

3. Cancellation and refunds

You can cancel at any time from the account settings or by writing to [email protected]. There is no contract term and no cancellation fee. After cancellation, you keep access until the end of the period you have paid for, and the subscription does not renew. We do not give refunds for partial periods, unused users or unused minutes, unless the law requires it. Before your access ends, you can export your recordings and port your numbers out.

4. Acceptable use

You may use the service only for lawful business communication. You must not:

  • place robocalls, prerecorded or autodialed calls without the consent the law requires, or run call campaigns that break telemarketing rules;
  • send spam texts, bulk unsolicited messages, or texts without the opt-in and opt-out that messaging rules require;
  • record calls where it is illegal, or without the notices and consent the law requires;
  • spoof caller ID to mislead or defraud, or use numbers you are not entitled to use;
  • harass, threaten or defraud anyone, or transmit unlawful content;
  • resell the service, or use it to run a call center for third parties, without our written agreement;
  • attempt to break, probe or overload the service, or access accounts that are not yours.

We may suspend or restrict numbers, users or the account when we see a breach of this section, fraud or a risk to the service or to carriers, and we will tell the account owner why.

5. Fair use of unlimited calling

Unlimited US and Canada calling is for the normal business use of one person per user license. It does not cover sharing one license among several people, using the service for automated or bulk calling, call termination services, or traffic that is far beyond typical business use. If use on an account is clearly outside this, we will contact the account owner first and may move the account to a suitable plan or limit the traffic that breaks this section.

6. Emergency calls (E911) and their limitations

VoIP 911 service works differently from traditional landline 911. Please read this section carefully and share it with every user.

  • Each user has a registered emergency address. When a user dials 911, that address is sent with the call. If the address is wrong or out of date, emergency services may be sent to the wrong place.
  • Users must keep their registered address current, especially when they move offices or work from another location. The account owner is responsible for making sure every user does so.
  • 911 calls need a working internet connection and power at the device. During an internet outage, a power failure, or if the device or network is not working, 911 calls may not be possible.
  • 911 calls from the apps on a mobile phone may also be placed through the mobile network of that phone, depending on the device.
  • The account owner must tell every user about these limitations. Keep another way to call 911 available where that matters.

7. Phone numbers and number porting

  • You may port your existing numbers into Youvoip at no charge. You confirm that you are authorized to move them.
  • Numbers you port to us or get from us can be ported out to another provider at your request, as long as the account is in good standing at the time of the port request.
  • If you cancel, you can port your numbers out until your paid period ends. After that, numbers that were not ported out may be released.
  • Numbers are subject to carrier and regulatory rules, and we may need information from you to assign or keep a number.

8. Your data and recordings

The content you create in the service, including recordings, voicemails and texts, stays yours. You give us permission to process it only to provide the service. How we handle personal data is described in our Privacy Policy.

9. Service availability

We work to keep the service available and to fail calls over to forwarding or voicemail when your connection is down. The service depends on internet connections, carriers and devices that we do not control, and it may be interrupted for maintenance or events outside our control. Any uptime commitment with credits applies only where it is written in an Enterprise agreement.

10. Warranties and limitation of liability

Except as stated in these terms or in a written Enterprise agreement, the service is provided as is. To the extent the law allows, Youvoip is not liable for indirect, incidental or consequential damages, lost profits or lost data, and our total liability for any claim is limited to the fees you paid for the service in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

11. Suspension and termination

We may suspend the service for non-payment after notice to the account owner, or at once when needed to stop fraud, abuse or a breach of the acceptable use section. You may end the service at any time by cancelling.

12. Changes to these terms

We may update these terms. We update the date at the top, and when a change is significant we tell account owners by email before it takes effect. If you continue to use the service after that, the new terms apply. If you do not agree, you can cancel before the change takes effect.

13. Governing law

These terms are governed by the laws of the United States and of the state in which the operator of Youvoip is established, without regard to conflict of law rules. Disputes are handled by the courts that have jurisdiction there, unless the law where you are located gives you a right to bring the claim elsewhere.
